This stance may echo across future contracts: developers and lenders depend on fixed SCOD and tariff applicability dates to lock financial closure. If a Power regulator repeatedly condones late filings—especially where both utility and generator claim “mutual grievance”—procedural discipline weakens, pushing pricing uncertainty into models for small hydro and solar. It also exposes coordination gaps within utilities, where legal and commercial teams move out of sync, amplifying procedural delay in SPPA execution.
For market stability, the Power regulator should codify time-bound protocols for review petitions and SPPA approvals, with clear consequences for slippage. Transparent, pre- defined windows—filing, hearing, and order issuance—would restore contractual predictability, reduce realization cycles, and align risk allocation with lender expectations. Until such guardrails are explicit, sponsors should hard-wire delay buffers, step-down tariffs, and liquidated damages triggers into contract structures to protect cash flows if regulatory clocks drift.
