Do all power exchange transactions qualify as inter-state? APTEL says No In a major judgment that redefines regulatory control over power exchange transactions, the Appellate Tribunal for Electricity (APTEL) has ruled that not all transactions on power exchanges automatically qualify as inter-state. The decision reinforces the role of state electricity regulators in governing certain open access transactions, particularly those involving embedded consumers within a state. APTEL clarified that simply purchasing power through a Power Exchange does not automatically make a transaction inter-state.
